ALBUQUERQUE, N.M. -- Police say a road rage incident escalated when a Rio Rancho man waved a gun at a family on Albuquerque's West Side.

Santiago Apodaca was charged with aggravated assault with a deadly weapon following the Sunday afternoon incident near Blue Water and Coors.

The caller said a man in a maroon Camaro pulled out a gun while the two cars were driving. According to the criminal complaint, an officer followed it to the parking lot of a Little Caesars.

Police say the driver claimed he didn't do anything wrong, didn't recall a road rage incident, and denied having a gun. But police say the passenger of the car told them otherwise.

The passenger reportedly told officers Santiago got involved in a road rage incident with a Crown Victoria, "which looked like a cop car." Court documents say Apodaca believed it was a cop car and then flipped it off his middle finger.

Both drivers started to argue, and the police report says Apodaca told the other driver he wanted to fight him. The passenger then told officers Apodaca flashed a gun at the other driver.

Court documents state the caller feared for her life and "believed the Camaro was trying to run them off of the road." Police say she then positively identified Apodaca as the driver.

According to those documents, Apodaca is currently on probation because of a case in Maine. He's now on a probation violation hold and will stay in custody until after the hearing.
