ALBUQUERQUE, N.M. -- It's been three weeks since an Albuquerque motorcyclist was shot and killed at a car wash at Coors and Quail. That night, the man who says he shot Earl Roybal was handcuffed and taken to a holding cell, but he never arrested or charged.

That man said it was self-defense, but Roybal's family and friends are demanding answers.

“It's under investigation,” said Rita Nunez-Gallegos, Roybal's aunt. “It’s still under investigation. We know it’s finally with the DA. I know sometimes the process takes long, but it’s been too long."

This week, APD released lapel cam and surveillance video showing Roybal's final moments at a northwest Albuquerque car wash.

“We all watched him and we all got angry and we all cried all night,” Nunez-Gallegos said.

Roybal's fiance told police Roybal and another man got into some sort of altercation at the car wash.
That same man called 9-1-1, saying he had shot Roybal.

“Something's got to come out,” Nunez-Gallegos said. “I mean I cannot see this, this case as self-defense.”

A spokesperson for the Bernalillo County District Attorney's Office said they're still waiting on crucial pieces of information before a decision can be made.

“I think looking at the footage,” Nunez-Gallegos said. “I don't know why there has not been an arrest.”

She said the wait has been trying. Roybal's mother even had to go to the emergency room because of her grief.

“I don't want to see her there again. She can't wait any longer for answers,” Nunez-Gallegos said. “Mother's day was devastating for my sister. She did not get a phone call, a card, flowers, anything, or even his laughter, and it's sad to see how she's going through.”
