A prominent Santa Fe attorney being tried for vehicular homicide was expected to testify today, but is now scheduled to take the stand Monday.

The judge ruled late Friday afternoon that the jury was too tired to hear Carlos Fierro's testimony, and scheduled him to take the stand first thing Monday morning.

Fierro is charged with driving drunk and striking and killing William Tenorio in front of a Santa Fe bar on a November evening last year.

Fierro’s attorney says that Fierro will admit to driving while intoxicated but describe the incident as unavoidable because of poor lighting and the fact that Tenorio was wearing dark clothing.

Witnesses throughout the trial have described seeing Fierro driving with no headlights and on sparking rims down Guadalupe Street after hitting a curb.
