Just after 9 this morning, Jurors began their third day of deliberations in the Carlos Fierro deadly DWI trial.
Fierro is accused of hitting and killing William Tenorio last November in Santa Fe while driving drunk. Tenorio's 12-year-old son, Terrell Velasco, said via a telephone interview that it's been tough since his father died. He says he wants people to know his dad was a nice guy and didn't deserve what happened. "I just think that I'm never going to see my dad again. And I'll never be able to see him again. And it's really hard to explain to my little sister," Velasco said. "I tell her he's in Heaven and he's going to be alright." Fierro admits to driving drunk, but his lawyers say poor lighting, Tenorio's dark clothes, and the fact that Tenorio's dark clothes and the fact that Tenorio was jaywalking led to the crash. Fierro's attorneys want jurors to convict Fierro only of DWI, and not vehicular homicide. Prosecutors said in closing arguments that death is not a punishment for jaywalking.
