LAS CRUCES, N.M. (AP) - Attorneys for a Las Cruces man accused in his infant daughter's death want a change of venue.
Lawyers for Robert Flores also say their client's right to a speedy trial has been violated. Defense attorney Mollie McGraw argued Monday that headlines and coverage in Las Cruces have sensationalized the case against Flores.
The 24-year-old Flores has pleaded not guilty to intentional child abuse resulting in death. His 4-month-old, Kalynne Flores, died in 2007. Police have said the child was left in a clothes hamper inside a closet while Flores went to buy beer.
Prosecutor Susan Riedel says there's no indication jurors can't separate information in news reports from facts at trial. She disputes defense claims that prosecutors took too long to file documents in the case.
