Luke Sanchez says he doesn't regret what he did.
"The window came through and I was getting attacked and I just remember the last thoughts were I'll never seen my son or my wife again," Sanchez said.
He was recalling what went through his mind the night two burglars attacked him. Sanchez killed one of them.
"I did the right thing, and I knew the whole time I did the right thing," he said.
It was July 4 and the former Marine was out buying sparklers for his kids when he says he spotted the burglary suspects at a Belen business and followed them when they left.
Eventually, they stopped.
Sanchez says they attacked him, so he shot in self-defense and killed Gary Gabaldon.
"How can I change anything? I can't change anything. If I wouldn't have defended my life that night I wouldn't be here talking to you," he said.
On Wednesday, a judge decided there wasn't enough evidence for Sanchez to stand trial for murder.
Sanchez said, "I hope the Gabaldon family will accept the decision." Gabaldon's mother said after the judge's ruling that justice wasn't served.
It's an ordeal that cost Luke Sanchez some of his freedom, and prescious moments away from his family, but Sanchez says he doesn't regret what he did.
"That night I was just defending my life," he said.
Now that it's all over, Sanchez says there's only one thing he wants: "I just want to get back to farming, that's it."
Sanchez says the first thing he did after the judge's decision was hug his wife.
