LAS CRUCES, N.M. (AP) - The district attorney's office in Las Cruces has declined to prosecute an East Mesa man accused of second-degree murder in connection with the stabbing of another man.
Prosecutor James Dickens said Friday his office has asked for follow-up investigation in the case.
Dona Ana County sheriff's investigators had accused 26-year-old Oscar Duran of stabbing 39-year-old Andrew Jobe in September at Duran's home during a fight.
Duran had told investigators he acted in self-defense.
Dickens says prosecutors didn't decide the stabbing was in self-defense, but that was an issue that was reviewed.
The case's lead investigator, Bo Nevarez, says the case will remain open on inactive status.
