Albuquerque officer subject of battery probe

ALBUQUERQUE, N.M. (AP) - An Albuquerque police officer is the subject of an aggravated battery investigation for an off-duty incident in a Hooter's restaurant parking lot that left a man with facial and rib fractures.

Prosecutors in Albuquerque have asked another agency to review the case because officer Joe Moreno is a witness in several cases.

Moreno has been on paid leave since Aug. 16. Police reports obtained by the Albuquerque Journal show the incident happened Aug. 1 between Moreno and fellow Hooters customer Jeffrey Grubbs as Moreno was leaving.

Their versions of what prompted Moreno to get out of his truck differ, but he punched Grubbs at least twice in the face and kicked him when he fell to the ground before driving away. Moreno's attorney didn't return calls from the Journal.
