Couple sues Army over arroyo cleanup dustup

ALBUQUERQUE, N.M. (AP) - A Santa Fe County couple is suing the Army Corps of Engineers over the government's threats to take legal action against them for cleaning up an arroyo on their 20 acre property.

Peter and Francoise Smith sued this week to stop the Corps from requiring them to get a Clean Water Act permit before removing more dead trees and debris from the property 19 miles southwest of Santa Fe.

Peter Smith tells the Albuquerque Journal  he cleaned up garbage and removed dead trees in the dry gulch. He says he was shocked when they got a certified letter from the Corps in mid-2011 accusing of violating the Clean Water Act.

The Corps says the law applies because the arroyo drains into the Rio Grande.
