LAS CRUCES, N.M. (AP) - Police say a months' long investigation into the death of a toddler has resulted in charges being filed against a Las Cruces man.

Police say 27-year-old Dustin Castillo was arrested and charged Thursday with one count of intentional child abuse resulting in death.

Castillo was booked into the Dona Ana County jail on a cash-only bond of $250,000.

On April 20, police were called to a home regarding an unresponsive child. Officers found Castillo holding 21-month-old Mariano Hernandez. Castillo told officers the boy had choked on a piece of candy.

The boy died two days later.

Investigators determined the boy had bleeding and swelling of the brain, a skull fracture, a lacerated spleen and other injuries.

Police say Castillo was friends with the child's relatives and had been caring for the boy and his sister for several months.
