NM family to get new trial in gun raid case

LAS CRUCES, N.M. (AP) - A federal judge has granted a new trial to a Deming couple and their son who were convicted of making false statements during a 2011 firearms sting at their gun store.

U.S. District Court Judge Robert C. Brack granted the new trial Friday after defense attorneys said prosecutors violated the defendants' due process rights.

The attorneys say prosecutors failed to turn over evidence that could have challenged the credibility of a prosecution witness.

The U.S. Attorney's Office said it was reviewing the order.

A jury convicted Rick and Terri Reese and their son, Ryin, in August of making false statements on investigation forms.

They were acquitted of most of the charges stemming from an investigation in which undercover agents posed as straw buyers of guns in 2011.
