A charter school teacher is on leave accused of having a state test in his desk.

Ted Padilla works at the Learning Community Charter School in Albuquerque.

Padilla said someone planted the test in hid desk.

"I don't have any access to these tests," Padilla said. "Two people here have them. And these two people have plenty of motivation to be upset at me. I have openly, critically - I have been critical of them in writing to the (school) board."

There will be a closed door executive meeting by the school's governing board Friday to talk about it.

The state Public Education Department, meanwhile, told KOB Eyewitness News 4 it is investigating complaints about the school. The department wouldn't say if those complaints are related to the state test allegations.
