Lawyers fight over evidence in Levi Chavez murder trial

ALBUQUERQUE -- A delay in the murder trial against a former Albuquerque police officer continues Tuesday after his attorney claimed key evidence was withheld from them.

Tuesday's hearing will determine what evidence must be released from a fraud investigation and a wrongful death lawsuit against Levi Chavez.

Prosecutors accuse Chavez of shooting his 26-year-old wife, Tera, with his department-issued gun in 2007 and trying to make her death look like a suicide. They also argue Chavez killed her to cover up an insurance fraud case, according to the Associated Press.

A dispute over notes from the fraud investigation caused a stay in the trial Monday and the jury was dismissed.
