ROSWELL -- Medical marijuana may be allowed in New Mexico, but the federal government still considers it illegal. It's up to New Mexico cities to decide if they want medical marijuana distribution centers.

Right now, there are no medical marijuana distribution centers in Roswell, and some city councilors want to keep it that way.

"It still as a law is illegal," said Roswell Planning Director Michael Vickers.  "So, is it legal because the state allowed you to, or is it illegal because the federal government says it's illegal?"

Those councilors said they want to follow the federal law. But that's upsetting people who use medical marijuana.

"There is probably a lot more people than they even realize have it in the city," said Michael Adams, a medical marijuana user.

The New Mexico Department of Health said there are 10,289 users registered in the state. Of those, 172 are in Chaves County.

Michael Adams had his medical marijuana license for two years, but he had to drive to Ruidoso to get it.

"It's just a hassle. I mean, it would be nice if there was something in town," Adams said.

He said taking medical marijuana helped him with post-traumatic stress.

"I got off a ton of prescription medications because of it. It helped me a lot," Adams said.

The city council still needs to vote on the medical marijuana ban, but at least one councilor says he'll vote against it.

"I will be against it, yes ma'am. Nothing will make me change my mind. I've been through it myself," Councilor Dusty Huckabee said,

The council will vote in December.

To set up a medical marijuana distribution center in Roswell, the city would have to approve it first. The city tells KOB they have not gotten any requests.
