A Shiprock High School teacher was fired, accused of refusing to let a student use the bathroom.

The school calls it child abuse, but the teacher's union is fighting to get her job back.

According to the Central Consolidated School District, on October 30 a student asked the teacher if she could use the bathroom.

After being refused several times, the student ended up going to the bathroom in the classroom.

Other students filmed the incident with their cell phones.

KOB Eyewitness News 4 talked to the principal, Rick Edwards, off camera and she says what makes this situation worse is that the bathroom was only ten steps across the hall from the classroom.

CCSD obtained the videos and after reviewing what happened put the teacher on administrative leave.

They later fired her.

The district admits the school was under lockdown at the time, but only because it was conducting a routine drug search. They say the teacher should have used better judgment.

"When there’s a lockdown when students lives may be threaten then obviously they can't leave the room, but when there’s a drug dog there’s enough latitude there to allow a student to use the restroom."

But the teacher's union, Central Consolidated Education Association (CCEA), disagrees.

"We believe that this teacher did what she was supposed during a lockdown which is to not let anyone enter or leave during a lockdown, and she did not and because of that she was discharged."

The teacher has filed an appeal to get her job back. The school board will decide Tuesday if they will hear the case.

KOB filed an inspection of public records request to get the cell phone videos taken of the incident.

We’re waiting to hear back from the district.
