Man charged in New Year's party death heads to court

BERNALILLO, N.M. -- A 20-year-old Rio Rancho man accused of killing his friend at a New Year's Eve party will face a judge today.

Police say Ryan Wathen shot 22-year-old Carlos Rueda in the head. But Wathen told investigators the shooting happened when Rueda told him to check out the gun.

Wathen told police that Rueda said the gun wasn't loaded. Wathen says his friend told him to put the gun to his head and pull the trigger, so he did.

Wathen will make his first court appearance Monday afternoon.
