Man killed by police in Moriarty standoff IDed

MORIARITY, N.M. -- State police have released the name of the man killed during a SWAT standoff in Moriarty on Tuesday.

Ernest Atebery, 40, was shot and killed after state police said he opened fire on officers outside his home. 

The incident started around noon when police responded to reports of a barricaded man firing a gun on Lexco Road. Officers found Atebery pacing back and forth on his porch while holding a rifle.

Atebery was in contact with the Torrance County Sheriff's Office on the phone, but negotiations stalled and that's when police said he fired shots in their direction.

Investigators have not yet determined Atebery's motive for firing the rifle.
