State Police: Teen shot by Espanola officer had 'cap gun'

ESPANOLA, N.M. -- New Mexico State Police say the teenager who was shot and killed by an Espanola police officer was holding a cap gun at the time of the shooting.

The incident happened earlier this month after investigators said 16-year-old Victor Vialpando called 911 and reported himself as a suspicious person.

When two officers confronted him, state police now say Vialpando was pointing a realistic looking cap gun at them before they shot him.

Several community members said Vialpando was the same student who allegedly made some type of threat at McCurdy Charter School in January.
