A judge ruled Wednesday that prosecutors have enough evidence to bring an Albuquerque woman accused of killing her airman husband to trial.
Amy Herrera pleaded not guilty Wednesday morning. The judge said the state did not present enough evidence to support a first degree murder charge. However, the judge did say the state can move forward with charges of second degree murder and involuntary manslaughter.
Air Force Major Marc Herrera was found dead in the couple's closet in July 2012. Investigators say he was shot during a party the couple was hosting for foreign exchange students who lived with them.
"I heard for too many months talk about manslaughter and second degree murder is still murder," Marc Herrera's family told KOB on Wednesday.
Amy Herrera's attorney argues the shooting was self-defense. She has avoided trial twice in the past because the indictments were dismissed.
