ALBUQUERQUE -- A Bernalillo County grand jury indicted an Albuquerque man Tuesday who is accused of fracturing his 5-month-old daughter's skull and punching the girl's mother more than 30 times.
Philip Duran allegedly assaulted the mother at a NE Albuquerque motel on August 16 after the two argued about the amount of time Duran was allowed to see their child.
According to a criminal complaint filed by Albuquerque police, Duran allegedly punched the woman more than 30 times and would not let the woman leave when she tried to.
She eventually escaped, and Duran chased her around the parking lot before returning upstairs to the motel room.
He then, according to police, grabbed the baby, still in her car seat, and allegedly threw the baby ten feet onto concrete stairs, fracturing the baby's skull.
A witness nearby used bear spray to stop Duran from doing any further damage.
Duran has been charged with two counts of child abuse, two counts of kidnapping, aggravated battery and criminal damage to property.
He is currently being held at the Metro Detention Center on a $100,000 cash only bond.
