Rodella lawyers file motions to dismiss grand jury count, disqualify prosecutors

Lawyers for embattled Rio Arriba County Sheriff Tommy Rodella have filed a motion arguing U.S. Attorney Damon Martinez misled a grand jury about Rodella's intent when the sheriff went after a man in his personal vehicle in March.

The lawyers claim Martinez was out to get Rodella after an incident involving federal Fish and Wildlife agents.

Court documents show U.S. Fish and Wildlife wanted Sheriff Rodella to deputize federal agents so they could stop motorists outside national forests to conduct Fish and Wildlife investigations.

Rodella declined to do so, and his lawyers say that is why federal attorneys are prosecuting him for the case in which Rodella and his son allegedly chased a man in an unmarked car, threatened him with a gun and hit him in the face with a badge before arresting him.
