Las Vegas man wants trial moved in child’s death

LAS VEGAS, N.M. (AP) - A defense attorney wants the trial of a man accused of shooting a 6-year-old girl moved out of Las Vegas because of media coverage.

Twenty-one-year-old David Levi Chavez is charged with an open count of murder in the death of Jasmine Garcia.

The child was sleeping in her mother’s bed when a shot through the wall facing the street killed her.

Authorities believe the bullet was meant for Garcia’s uncle.

Chavez is to go on trial next month, but his attorney, Bob Gorence, has asked state District Judge Abigail Aragon to move it to Albuquerque or Santa Fe.

He says prospective jurors likely have been tainted by media coverage and emotional assertions by people interviewed.

The district attorney’s office opposes moving the trial.
