FARMINGTON, N.M. (AP) - A Farmington attorney who opposes red-light cameras in Farmington is fighting two tickets he received after his cars were caught on camera zipping through Albuquerque intersections.
A district judge rejected Victor Titus’ claims, and he has appealed last month to the state Court of Appeals.
He contends Albuquerque’s ordinance violates state law and the federal constitution.
The ordinance authorizes cameras for speeding and people running red lights.
A state district judge in 2007 ruled the state Constitution allows Albuquerque to declare speeding and running red lights a nuisance—the legal foundation for the cameras.
According to tickets, Titus’ his cars were speeding through Albuquerque intersections in October 2006 and August 2007.
He says he wasn’t driving but purposely hasn’t asked family members who was.
