Santa Fe attorney on trial in pedestrian death

SANTA FE, N.M. (AP) - A Santa Fe attorney is on trial on a charge of vehicular homicide in the death of a pedestrian in the capital city last November.

The trial of 36-year-old Carlos Fierro began Monday morning before state District Judge Michael Vigil.

The prosecutor in opening arguments told jurors that Fierro had "had a lot to drink" and almost hit a second person before striking 46-year-old William Tenorio."

Police have said Fierro was at the wheel of a vehicle that struck Tenorio of San Felipe Pueblo last Nov. 26 and then left the scene.

The defense told jurors that Fierro will stipulate he was drunk but argued, "This was an accident and not a crime."

Authorities allege Fierro's blood alcohol level was more than double the legal limit.

The trial is expected to last two weeks.
