A 31-year-old woman is in jail facing DWI and child abuse charges while her infant daughter is in critical condition at University of New Mexico Hospital.

Investigators say that Hope Gallegos had been at a house party Saturday evening. She left early Sunday morning with her daughter in a car seat and hit a metal pole in the side of the highway at about 4:30.

The pole folded over the truck and crushed the 16-month-old infant in her car seat.

“The children, they’re the innocent ones that have no way to stop the harm coming to them and it’s just very sad that a parent would let this happen to their own child,” said Valencia County Deputy Chris Trujillo.

Deputies say that the results of a breath test given to Gallegos revealed a blood-alcohol level of 0.09 – just above the legal level of presumptive intoxication of 0.08.
