TorC judge scheduled to hear own son's statutory rape case

A former Truth or Consequences police officer charged with impregnating a 15-year-old girl, and later marrying her, is set to go before a judge.

Noah Pestak, 29, is scheduled to go to court and stand before his own father, T or C Magistrate Judge Thomas Pestak.

Pestak is facing six counts of statutory rape, including three counts for sexual penetration of a minor and others for attempting to tamper with evidence.

Some believe Pestak married the 15-year-old to avoid charges. They were married in a courthouse ceremony in May.

Investigators said Pestak gave the teenage girl $425 to pay for an abortion, but she missed the appointment and then decided not to have the procedure.

Sierra County Sheriff's Office said the tampering with evidence charge stems from Pestak trying to get the girl an abortion.

The case is in Pestak's father's jurisdiction, so it was automatically assigned to his courtroom.

According to Judge Pestak's clerk, he will recuse himself and send the case to another judge.

Pestak is out of jail on bond.
