Police report offers details leading up to law office shooting

New information was released Wednesday morning that shed some light on why a man may have been shot outside the Chip Venie Law Office Tuesday morning.
Albuquerque police arrested David "Chip" Venie for shooting Stephen Biddinger, who police found leaning on the wall outside Venie's office on Lomas and 8th with a gunshot wound to the leg.
In the police report, one officer said Biddinger told them Venie shot him after saying Biddinger smelled.
Biddinger was released from the hospital Wednesday morning and reported to a homeless shelter in Albuquerque. Another man at the shelter said he helped Biddinger into the shelter. He heard the same story from Biddinger that was recorded in the police report.
"As soon as I went up to him, he (Biddinger) said a lawyer shot him," Ralph Lowry said.
He went on to explain what else Biddinger told him.
"He was walking up next to some guy on the sidewalk and the guy turned over to him and said you stink," Lowry said.
According to the police report, Venie would not let Biddinger come into his office at 833 Lomas. Several other witnesses reported Venie went into his office and brought out a gun. He later shot Biddinger in the leg, according to several witnesses and a cellphone video. The video was taken by Venie's wife at the scene.
Police interviewed three witnesses, including Venie following the shooting. They determined Venie shot Biddinger, and charged him for aggravated assault with a deadly weapon after seeing from video that Biddinger did not have a weapon.
Venie bonded out of jail and after checking his office, no one would answer his door. KOB Eyewitness News 4 left him a message on his office phone, but no one has called back.
