New Mexico man acquitted in stepson's shooting

 LAS CRUCES, N.M. (AP) - A New Mexico man charged in the shooting of his adult stepson was acquitted on an aggravated battery charge.

The Las Cruces Sun-News reports that a jury found 51-year-old Grover Herring of the southeastern New Mexico city of Anthony not guilty of aggravated battery against a family member with a deadly weapon.

Dean Clark, Herring's attorney, says he didn't contest that Herring shot his then-25-year-old step-son with a revolver, but that he did so in self-defense because the stepson was under the influence of drugs and had struck and pushed his mother.

Prosecutors had argued that the force Herring used was excessive.
