Prosecutor: Actions of Laguna man who killed bicyclist were 'revolting,' not criminal

A Laguna Pueblo prosecutor says Gilbert Waconda actions were “revolting” but did not violate the terms of his sentencing for killing a young bicyclist.
Minutes after being sentenced Monday to 182 days in jail for the reckless driving death of John Anczarski, 19, Waconda posted a comment on his Facebook page saying he hoped Anczarski’s family would “burn in hell” for all they’d put him through.
His Facebook page has since been taken down.
Anczarski died in 2010 as he rode his bike across the Laguna Pueblo as part of a cross-country ride for cancer fundraising and awareness.
After being sentenced in tribal court, Waconda stuck his tongue out at a KOB photographer and reporter.
Laguna Pueblo prosecutor Carlos Pacheco told KOB on Tuesday that he reviewed Waconda’s condition of release and did not find anything about him being barred from contact with the victim.
Waconda's behavior, he said, was “revolting, but not criminal.”
Waconda is scheduled to begin his sentence Wednesday at 10 a.m.
He will also have to serve 600 hours of community service, including 100 raising awareness for breast cancer
