Judge ok's move for boy accused in father's slaying

A New Mexico boy accused of shooting and killing his father, has been given permission to move out of state.

Ben Hilburn was just 10 years old when police say he shot his father in the head.

The shooting happened in 2009 at their Valencia County home.

Hilburn's attorneys went before a judge Thursday asking if the now 13-year-old boy could move to Oklahoma with his step-father to have more normalcy in his life.

The judge said yes.

Hilburn will have to report to a probation officer once a month in person and call in every week.

His trial is set to begin May 20.
