No probable cause in Albuquerque shooting death of neighbor

ALBUQUERQUE, N.M. (AP) - Albuquerque police say they don't have probable cause to charge anyone in a recent shooting death.
Police tell the Albuquerque Journal that 24-year-old Jonathan Mitchell was fatally shot Tuesday by neighbor Donnie Pearson.
Pearson had gone to Mitchell's house to do a welfare check. Police say Mitchell had brandished a gun at another neighbor earlier that night.
Pearson and his 15-year-old son eventually went to Mitchell's house. Pearson told officers he saw Mitchell run from a neighbor's house into an open garage. As Pearson stopped by the garage, Mitchell stepped out and fired at Pearson and his son.
Pearson's son ducked, while Pearson retrieved his own gun and fired back. Pearson has a concealed carry permit for a handgun.
