State police: Officer who shot at van with kids inside fired

New Mexico State Police officials confirm that the officer who shot at a van with children inside during a traffic stop in Taos has been fired.

Officer Elias Montoya was terminated Friday as result of the investigation into the shooting, according to Lt. Emmanuel Gutierrez. 

On Oct. 28, a state police officer pulled over Oriana Farrell for speeding. After arguing about the ticket, Farrell drove off, resulting in a pursuit. In dashboard camera video of the incident, the officer pulls Farrell over again and demands for her to get out of the car.

The children inside begin to scream and Farrell's 14-year-old son gets out of the van and confronts the office. A struggle ensues and two more officers are called to the scene.

When Farrell attempted to flee for a second time, officer Montoya can be seen firing three shots at the rear tire in the dashboard video.

The state police chief says there will be no further comment until all appeals have been exhausted.
