ABQ man displaying abortion ban sign faces fine, jail time

It has been almost a month since the city of Albuquerque's special election on a late term abortion ban, and a lot of the signs for and against still stand around town.

One man says he was cited for still having his sign up, even though no one can see it. 

Joe Fresquez says he collects signs and displays them in his back yard. 

One of those signs is for the late term abortion ban. 

He says he is not trying to make a political statement. 

He just honestly likes the sign.

But according to city ordinance, all political signs must be removed ten days after the election. 

Keeping it up could cost him a fine of up to $500 dollars and 90 days in jail each day he keeps it up.

Fresquez says it is not fair because he sees them all over the city and they are in plain view.

"They are actually facing the public, the streets for people to see.  Mine is not even facing the public," Fresquez said.

Fresquez thinks he is being targeted because his neighbor does not like him, and has a relative who works for Code Enforcement. 

KOB Eyewitness News 4 called the city about this case. 

KOB was told they would review the case and get back to us on Monday.
