Santa Fe man sentenced to 32 years for double murder

A Santa Fe man who pleaded guilty to killing his 17-year-old pregnant girlfriend and her father was sentenced to 32 years in prison on Wednesday.

Last month, 27-year-old Marino Leyba pleaded guilty to second degree murder in the shooting deaths of Sarah Lovato and 50-year-old Bennie Ray Lovato as part of a plea agreement. Leyba faced a maximum of 32 years in prison under the deal.

Leyba was initially convicted of first degree murder in 2010, but the state Supreme Court overturned the verdict last year.

The court ruled that Lovato's diary, in which she wrote about being afraid of Leyba, should not have been allowed in the case as evidence because it is considered hearsay.
