New Mexico Attorney General Gary King says the state is avoiding responsibility in the case of a boy kicked to death by his mother.

King says caseloads at the Children, Youth and Families Department have risen to unmanageable levels.

Synthia Varela-Casaus, the mother accused of kicking her 9-year-old son to death, has a history of CYFD interventions, but state officials have said there were no open cases at the time of the incident.

A spokesman for Gov. Martinez says that as a former prosecutor, the governor has dedicated her professional life to protecting children. Her administration has hired more than 300 social workers in the past three years.
