Judge rules Ortiz recall can proceed

Judge Alan Malott ruled Thursday afternoon that recall proceedings against Bernalillo County Treasurer Manny Ortiz may proceed.

Ortiz faced the judge today, where evidence was presented to determine whether he should face a recall election.

Judge Malott made it clear he was ready to make a decision, and ten minutes later ruled there was reasonable evidence to warant a recall election. A petition for one may now circulate.

County resident George Richmond said the last audit of the treasury showed shady investment practices that meant Ortiz should face a recall.

Judge Malott said there is evidence showing recommendations concerning investment lengths were ignored by Ortiz, and there are now questions about whether that decision caused a money crunch.

Malott also said a recent audit of the tresaury showed a possibility Ortiz may have violated investment practices.

If the plaintiff can get 82,000 signatures, Manny Ortiz will face a recall election.
