Albuquerque police continue their search for a mystery man who’s been using a squirt gun to shoot kids along a major city street – but they’re not sure he’s actually breaking the law.

Police say he approaches kids along Eubank Boulevard and asks their permission if he can shoot them with a squirt gun while videotaping them getting soaked. What if that was your kid?

That was the hot question of the day Thursday at the dog park at Eubank and I-40 among the men who call themselves the Geezers Club. They’re keeping an eye on the street – but no sign of Mr. Squirt.

“Who knows what’s in the water,” said Roy Brooks. “Might be something in the water. Should be against the law. Maybe it isn’t, but it should be.”

“He’s not threatening anybody,” said Charlie Chavez. “He’s got every right to approach you and ask you questions if you don’t mind. I don’t see where he’s breaking the law at all.”

Prosecutors and police aren’t sure either. Police in Port St. Lucie Florida arrested a 19 year old woman for assault  last year after she shot a squirt gun at her boyfriend during a domestic dispute. Seattle cops arrested a man in a street protest in Oct. 2011 when he squirted an officer with water from a squirt gun. But the Albuquerque squirter asks permission first. Prosecutors say they need more information before they can determine whether it’s assault or battery or a harmless stunt.

Police are distributing a photo of a man they say is not a suspect, just somebody they want to talk to about the squirt gun spree.  Kids who got wet describe the squirter as a white male, 20 to 30 years old with brown hair, who at times wears a baseball cap.
