The stepfather of 9-year-old Omaree Varela is behind bars.

But Steve Casaus is not in jail on charges related to the boy’s death.

Police say Omaree was kicked to death by his mother last year.

Several organizations have called for child abuse charges against Casaus.

Police say they saw Casaus driving and swerving at San Mateo and Montgomery early Sunday morning and believed he was drunk.

They pulled him over in front of his friend’s house on Madison Street.

Police searched his car and found weighing scales and a large amount of pot, meth and heroin.

Community civil rights groups, such as the Albuquerque NAACP and the state chapter of the Southern Christian Leadership Conference, threw their support behind a new petition that is asking the district attorney to look into possible charges against Casaus in the boy’s death.

KOB Eyewitness News 4 caught up with Governor Susana Martinez who was not surprised by the news.

"It's just sad to see that parents responsible for children would have drugs anywhere near them around them or use them around children, it’s just very harmful, " Martinez said.

Police say Casaus failed the intial sobriety test.

He is being held at the county jail for possession of methamphetamine and is expected to face a judge Monday.
