The Sandoval County treasurer is facing a charge of aggravated battery after a fight with her boyfriend.

According to police, Laura Montoya asked her boyfriend to delete pictures of her from his phone. When he refused, police said she took the phone, bit his arm and punched him in the face when he tried to get it back.

Montoya faces a misdemeanor charge of aggravated battery.

She is an elected official and remains on the job.

In a statement, Montoy's attorney said: "Ms. Montoya acted in self defense. She has been falsely accused and looks forward to her day in court. She will continue, as always, to serve her community."
