Embattled Bernalillo County Treasurer Manny Ortiz plans to fight a recall petition that could put him out of office.
Ortiz's attorney filed a notice of appeal to the New Mexico Supreme Court regarding a district court judge's ruling to allow the petition.
At the end of January, Judge Alan Malott determined there was evidence showing recommendations concerning investment lengths that were ignored by Ortiz. He said there are now questions about whether that decision caused a money crunch.
Malott also said a recent audit of the treasury showed a possibility Ortiz may have violated investment practices.
But Ortiz denies allegations that he mishandled county finances, and said on the stand that he paid every bill that came into his office. He previously called the state audit that accused him of breaking state laws "nothing but trash."
If the recall petition reaches 82,000 signatures, Ortiz would have to face a recall election.
