Brother plans lawsuit in police shooting of homeless man

The brother of the homeless man shot and killed by officers in the foothills plans on pursuing a wrongful death lawsuit.

On Friday, James Boyd's brither, Andrew, filed court papers to be named Boyd's personal representative, which would allow him to pursue a wrongful death claim.

The city of Albuquerque could not find Boyd's family after he was killed in the shooting on March 16. But last week, KOB Eyewitness News 4 tracked down Andrew in Alabama. 

Andrew would not tell KOB how long it had been since he spoke with his brother. He said he found out about Boyd's death by seeing the lapel camera video of the shooting online.

Boyd's family is making arrangements to have his body released to them for funeral services.
