Man accused of causing girlfriend to miscarry baby

An Albuquerque man accused of sitting on his girlfriend's stomach while she was pregnant and causing her to miscarry appeared in court on Saturday.

Police said the woman was bleeding from her left ear when they interviewed her on April 17. She told officers she was also bleeding from having a miscarriage.

This is not the first time Joseph Benavidez has been accused of abusing his girlfriend. He also currently faces charges for false imprisonment and battery for an incident in February.

But in court on Saturday morning, Benavidez told a judge he has documents at home proving that the woman was not pregnant.

The judge advised him to get a lawyer and set his bond at $250,000 cash only.
