It does not matter if you're at a stop light or stuck in traffic--starting Tuesday, texting while driving is illegal throughout New Mexico.

The state Department of Transportation plans on releasing a commercial in connection to the ban. It shows shocking statistics: Nearly 1 in 5 crashes resulting in injury involve a distracted driver.

Studies show that texting while driving makes motorists 23 times more likely to crash.

In New Mexico, the first citation for texting while driving will be $25. For repeat offenders, the penalty will be $50. However, there are additional fees imposed on all citations. These fees bring the total fine to $82 for the first offense and $107 for the second and subsequent offenses.
