Albuquerque police say a man killed by U.S. Marshals two weeks ago pointed a BB gun at a deputy before he was shot.

On July 2, deputy marshals attempted to serve a federal arrest warrant near 98th and Dennis when they shot Anthony Jacob Chavez, 27.

Chavez was wanted on a probation violation related to a 2010 charge for bringing undocumented immigrants into the country.

APD communications director Janet Blair confirmed Chavez pointed a BB gun and threatened a deputy during the incident. The deputy marshal then discharged an agency-issued firearm, resulting in Chavez's death.
