A lawsuit filed against the City of Albuquerque and APD over the death of a well-known civil rights lawyer has been dismissed.

Mary Han was found dead in her garage in November 2010. Her death was ruled a suicide, but her friends and family never believed she killed herself.

The Han family filed the lawsuit claiming police mishandled the investigation.

The city put in a motion to get the lawsuit dismissed. A judge ruled in favor of the city and police department this week.

An attorney representing Han's family says they plan to appeal. The family has also filed a lawsuit against Albuquerque attorney Paul Kennedy.

That lawsuit accuses Kennedy of withholding vital information that is preventing the family from determining the full value of Han's property.

APD says Kennedy is the one who found Han's body. He served as her law partner before her death.
