The man accused of taking a baby and stabbing his father to death outside a gas station on Labor Day appeared in Bernalillo County Metropolitan Court on Tuesday.
A judge set 32-year-old Michael Fox's bond at $1 million cash only.
Fox is charged with first-degree murder and tampering with evidence in the stabbing death of Kenneth Boyd, 24. Albuquerque police said Fox attacked Boyd at the Circle K gas station on Wyoming and Constitution.
Boyd met Fox at the gas station to pick up his infant son. Boyd's girlfriend told police Fox drove away with their child while giving the family a ride from a party in Edgewood on Monday.
But the story Boyd's girlfriend told police differs from what a witness inside the car recounted. According to the criminal complaint, the witness told police Fox kicked Boyd and his girlfriend out of the car because they were arguing. The girlfriend told police Fox let them out of the car to retrieve a bottle for the child in the trunk.
When Fox left the couple on the side of the road, the witness said Fox punched her when she demanded to be let out of the vehicle.
The Torrance County Sheriff's Department located Boyd and his girlfriend on the side of the road and took a report. Edgewood police drove the couple back to their home.
The witness in the vehicle with Fox said she received a phone call saying an Amber Alert had been issued for Boyd's child. When Fox learned about the alleged Amber Alert, he told the witness he wanted to give the child back.
Fox drove his car to the Target parking lot across from Coronado Mall. As they waited for Boyd and his girlfriend to arrive, the witness said Fox became paranoid and then drove off. They eventually stopped at the Circle K, where Fox got out of the car.
Several witnesses at the scene said the men got into a fight before Fox stabbed Boyd with a knife in the stomach.
Before the attack, Boyd's girlfriend told police she was able to retrieve her child from the parking lot and said she attempted to get Boyd back into the vehicle, but he refused.
Boyd was pronounced dead at UNM Hospital.
