Cuba man accused of killing roommate with baseball bat

CUBA, N.M. – A 33-year-old man from Cuba has been charged with an open count of murder, in the murder of his roommate.
New Mexico State Police say it all started when they were called to the Circle K in Cuba last Saturday to do a welfare check on a person in a truck. Inside the truck was Kimsey Barboan, who appeared to be intoxicated and had a cut on his forehead.
Barboan told officers that he was assaulted by a group of men. During that interaction officers noticed a baseball bat and a rifle inside the truck.
Barboan was taken into custody and booked on charges including DWI and felon in possession of a firearm. Police say he also had two active warrants out for his arrest.
On Monday, 911 operators out of the Sandoval County Sheriff’s Office received a call from friends of 61-year-old Anthony Martinez who said they had found him dead inside his home.
Officers arrived on the scene to discover that a struggle had taken place inside the home, and that Martinez has suffered blunt force trauma.
Investigators came to find that Mr. Martinez and Mr. Barboan had lived together at the home and had gotten into a fight Saturday night. Barboan told police that Martinez hit him with a bat, so he took the bat and began to hit Martinez.
Barboan said Martinez was on the ground making groaning noises when he left the house. Barboan has been charges with an open count of murder and tampering with evidence.
