ALBUQUERQUE, N.M. -- Some surprises are good, others not so much. An Albuquerque man was surprised when he bit into a store bought cobbler and it crunched.

That man, Phillip Candelaria, said he's purchased pies from his neighborhood Walmart on numerous occasions with no complaint. But that changed last week he said he choked on what appeared to be a thorn in his food.

"At first I was just chewing it and I thought it was just the seeds of the berry but no," he said. "Surprise!"

Candelaria said that mysterious seed had him gasping for breath, even choking. Now he's been searching and sifting through his blackberry cobbler he bought a week ago.

"Last week I went to Walmart and purchased a cobbler and I usually get apple or peach. but they had the blackberry for a reduced price," he said.

Candelaria believes that blackberry pie still had some blackberry thorns.

"This thorn right here got stuck in the back of my throat and I had to work to get it out you know,” he said.

But that wasn't the worst part. He said when he went to tell the store, he thought he saw those same pies still sitting on store shelves.

"It's an unsafe product. The thing is they're placing profits of safety, that's just not acceptable," Candelaria said.

However, a Walmart spokesperson said once that complaint was filed, they checked those shelves at the Walmart on Sage in Southwest Albuquerque and didn't find any other personal pies of that same brand.

"I hope that they really do an investigation and pull the product off and make good on it," said Candelaria.

As for a complete product recall, the Walmart spokesperson said that depends on the supplier. Walmart said it does pass those complaints on to the supplier while doing its own investigating.
