ALBUQUERQUE, N.M. -- A 12-year-old girl she was on her way to a bus stop to get to school when she says a man grabbed her hand and then sexually assaulted her.

Police say the middle schooler fought off the man trying to kidnap her.

"She tried to tell him to leave her alone," said Michelle Gurule, the girl’s mother. "He then grabbed her from behind and rubbed her private part, and she just fought and fought. And he hit her over the head with something, and she fought and fought and got away from him."

Gurule said her daughter hopped into a neighbor's backyard to get to safety and gave police a description of the alleged suspect. Police have identified him as Armando Chavez.

Chavez has been charged with kidnapping. He's currently in custody on a no-bond hold.

"He needs to stay behind bars. He needs to be charged for everything he did to my daughter," she said. I just hope that the system doesn’t let my daughter down, and if they do I'm going to fight tooth and nail until my daughter gets justice for what he did to her."

Gurule said she's seen Chavez around before, and that he lives in the neighborhood. She even took a picture just in case something happened, but she never expected this.

"I encourage any child or parent who has been involved with this man or seen him around to come forward," she said.

Gurule said she’s angry and hurt knowing her daughter was in serious danger.

"I'm so proud of her. She just fought, and I've always taught them to never talk to strangers. 'Don't go around and talk to people you don't know,'" Gurule said. "If you ever got attacked, you fight that person as hard as you can with all your will, and that's exactly what she did."
