ALBUQUERQUE, N.M.- BYD, the bus company hired to build buses for the Albuquerque Rapid Transit project, said it will hire independent transportation experts to inspect its buses.

BYD said it is confident that the examination will prove that the buses sent to Albuquerque are safe and fit for service.

Albuquerque Mayor Tim Keller said Tuesday that the city would reject BYD's buses, citing brake failures and other malfunctions.

Keller also said the city has begun to look for buses from alternative companies.

BYD alleges Keller has been against the project and the bus company since he campaigned for mayor.

BYD also said it would take all appropriate legal action to "protect itself in light of City Hall's conduct."

Mayor Keller office released a response to BYD's statement, saying, “We’ve laid out the facts since the beginning, and these buses are not safe for the road. We refuse to jeopardize the safety of our residents and want BYD to hold up their end of the deal,” said Alicia Manzano, Communications Director for Mayor Tim Keller.
